We reserve the right, without prior notice, to limit the available quantity of or discontinue any product or Service; to honor, or impose conditions on the honoring of, any coupon, coupon code, promotional code or other similar promotions; to bar any user from making any or all purchase(s); and/or to refuse to provide any user with any product or Service. To the extent allowed by law, MICHAEL THOMAS COLLINS liability for any claim relating to any product purchased from us is the amount you paid for the product.
1. ORDERS: You are responsible for supplying all required information when submitting an order, including complete name, shipping and billing address (no P.O. Boxes), telephone number, valid e-mail address, and valid payment method. All orders placed with a receiving address outside the United States are prohibited, and any attempts to circumvent our Services for delivery outside the United States will be denied. No responsibility is assumed for mis-delivery due to incorrect information supplied by a customer. MICHAEL THOMAS COLLINS reserves the right to refuse or cancel any order at any time, in which case the customer’s sole remedy is a refund of any payment(s) made for such order.
2. CHANGES: Changes to an order may not be made once an order has been placed. Delivery address may be changed if your order has not yet shipped, and authorization of these changes are to be decided solely upon our discretion. 3. PAYMENTS: Payment for any order must be made at the time the order is placed. You may pay for your order by credit card through our online checkout system. In the event of a stopped payment, disapproved charge or other failure to submit pre-payment, MICHAEL THOMAS COLLINS has the right to cancel the order or, if already shipped, to seek payment and hold customer responsible for any and all costs of collection, including but not limited to reasonable attorneys’ fees, as well as to charge interest at the rate of 1.5% per month (or the highest allowable rate by law if less than 1.5% per month) until payment is made.

COLOR MATCHING: You acknowledge and understand that colors, resolution and image layouts seen on a computer monitor may vary from colors, resolution and image layouts as they appear on our manufactured products, and no guarantee is made that any image as seen on an electronic device will necessarily match the final product.

6. SALES TAX: Applicable sales tax will be added to all orders destined to locations in the State of New Jersey and all states where we are required to under economic nexus laws. For all orders destined to other states, sales and use tax should be paid by the customer where required by law.
7. DELIVERY: Please allow up to 4 weeks for your product to be shipped. While your order is submitted into our system shortly upon payment, all orders are custom created on an individual basis and necessary time is taken to fulfill, process and pack each order before shipping. You may also be subject to wait times based on drop shipped order fulfillment. MICHAEL THOMAS COLLINS makes no representations or warranties, either express or implied, of any kind with respect to products sold on this Site.
8. RETURN AND REFUNDS: To be eligible for a return, your item must be unused in the original packaging and in the same condition that you received it. We require a receipt or proof of purchase for all returns. Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a refund or exchange. Notification of all shipping defects or damage must be made within 10 days of delivery and accompanied by the shipping receipt and photographic proof of the damage for us to review. If we approve of a request for a replacement, entirely at our sole discretion, we will not charge you for the new print, but you will be responsible for the costs of returning the damaged print to us, plus the cost of shipping the new print to you.There are certain situations where only partial refunds are granted. Downloadable digital products are not eligible for return or refund. If your use of our Site or Services has been terminated for violation of these Terms of Sale or our Terms of Use, we may refuse to accept any returns from you. To complete your return, please email us at support@michaelthomascollins.com with reasons for the return request, attached receipt or proof of purchase, attached photos indicating damage or quality issues, and await our further instructions. Please do not send your purchase back to the manufacturer. You will be responsible for paying shipping costs for returning your item. Shipping costs are non-refundable. If you are eligible for a refund, and we choose to send you a return shipping label, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you may vary. If you are returning the item under your own shipping method, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment within 7-10 business days. PERSONAL USE AND RESTRICTIONS: By purchasing any selected photographic prints or other goods (“Products”) you hereby agree and acknowledge that you are not acquiring any right, title or interest in or to the Products or any associated copyrights or licenses, other than the right to possess, hold and use the Products for non-commercial purposes. Furthermore, you agree that you will: (i) not scan, copy, duplicate or otherwise reproduce the Products, (ii) not use the Products for any commercial purpose, without the express written consent by MICHAEL THOMAS COLLINS and (iii) indemnify MICHAEL THOMAS COLLINS and its affiliates, officers, members, managers, employees and agents against any claims, losses or damages incurred as a result of or in connection with your breach of the foregoing restrictions. You also hereby acknowledge that the Products are being produced and manufactured by a third party chosen by us, and that Michael Thomas Collins is not involved nor otherwise responsible or liable for the production or manufacture of such Products.
